Terms of Use

1. Acceptance

By creating an account or using Kapital Fútbol (the 'Platform') you accept these Terms and the Privacy Policy. If you don't agree, don't use the Platform.

2. What we are (and what we are not)

Kapital Fútbol is a sports news portal and a peer-to-peer connection platform for sticker collectors.

We are NOT sellers, financial intermediaries, or inventory custodians. Trades between users happen outside the Platform; we do not process payments.

We do NOT guarantee the accuracy of listings, the condition of stickers, or trade fulfillment. Users are responsible for verifying their counterpart's identity and trade conditions before transferring money or goods.

3. Accounts

You must be at least 14 to create an account. You are responsible for keeping your password confidential and for all activity under your account.

We reserve the right to suspend or delete accounts that violate these terms, without prior notice when the case warrants it (fraud, abuse, impersonation).

4. User conduct

By using the Platform you agree NOT to:

• Post false, misleading content or that infringes third-party rights.
• Impersonate another person or entity.
• Request payments before verifying your counterpart's identity.
• Share contact information (WhatsApp, Telegram, phone numbers, emails) in chat before completing at least one trade — chat exists to protect you and build reputation.
• Use the Platform for illegal activities or to promote hate, violence, or discrimination.
• Attempt to access parts of the Platform you don't have permission for.
• Engage in mass scraping, denial-of-service, or any technique that disrupts normal operation.

5. User-posted content

You retain ownership of what you post. By posting you grant us a non-exclusive, worldwide, royalty-free license to display that content within the Platform for the purpose of operating the service.

We reserve the right to remove content that violates these terms without prior notice.

6. Editorial content (news)

News published on the Platform consists of original writeups assisted by artificial intelligence based on information from public sources (sports media, official RSS).

We cite the original media source by name. We do not reproduce proprietary text or images.

Opinions expressed in editorial articles do not represent official positions of any club, federation, or player.

7. Reports and moderation

If you find content that violates these terms you can report it from the listing or profile. We review reports and take action when warranted.

Moderation decisions are final, but you may appeal by writing to kapitalfutbol@gmail.com.

8. Intellectual property

The 'Kapital Fútbol' brand, logo, visual design, and Platform code are property of Kapital Fútbol.

Team names, players, leagues, and publishers mentioned on the Platform belong to their respective owners and are used for informational purposes under fair use principles.

9. Limitation of liability

The Platform is offered 'as is', without guarantees of continuous availability, absolute accuracy, or fitness for any particular purpose.

To the maximum extent permitted by law, we are not liable for direct, indirect, incidental, special, or consequential damages arising from your use of the Platform, including (but not limited to) losses from failed trades between users, errors in posted information, or service interruptions.

10. Indemnification

You agree to indemnify us against any claim arising from your use of the Platform or your violation of these terms.

11. Modifications

We may modify these terms. Substantial changes are notified on the Platform at least 15 days in advance. Continued use after the effective date implies acceptance.

12. Governing law and jurisdiction

These terms are governed by the laws of the Republic of Ecuador. Any dispute will be resolved by the competent courts of Guayaquil, Ecuador.
